HEALTH

The client realises that pole and aerial training consists of dance and acrobatic elements that go beyond the limits of everyday life and ordinary fitness or physical education. By booking a lesson, the client confirms that they can attend the class for health reasons. The client understands that the studio staff are not doctors. In case of any doubts, the client must consult a doctor about the possibility of attending a class. The client is obliged to inform about any physical limitations and pregnancy before the class starts. The client is obliged to follow all the instructions of the teacher and to follow safety precautions. 

RESPONSIBILITY

  • Way to Pole & Dance represented by Elena Bosalygo is not responsible for any injuries sustained by the client while attending classes, open workouts and/or special events. The client participates in classes, events and open training at their own risk. Classes are potentially injurious; by attending a class, open training session or event the client understands this and accepts full responsibility for the consequences.

  • Way to Pole & Dance represented by Elena Bosalygo is not responsible for loss or theft of personal belongings.

CLASS BOOKING

Booking

Classes are booked in advance online via the booking system on the website. The class fee must be paid in full during booking. Registration for a class does not entitle you to participate if the class fee has not been paid on time. Only after payment is made will the client be assigned a place on the chosen class.

It is not possible to attend a class without registration in the booking system. By registering for a class, the participant undertakes to pay the class fee. Furthermore, they hereby confirm that they have read and accepted these General Terms and Conditions.

Before booking, the client is advised to read the class descriptions and levels, which will help to choose the level that best suits the client’s current level. If the client chooses a level that is not appropriate, the class fee will not be refunded. In case the client doubts which level to choose, the client can email info@waytopoleanddance.de 1-2 of their videos, the studio’s staff will make a recommendation which level to choose.  

Prices

The studio has a pricing policy. All prices are presented on the website and / or in social media. Way to Pole & Dance represented by Elena Bosalygo reserves the right to change prices, which will be announced on the website and social media. If prices are changed, packages already purchased will remain unchanged in value. Customers with membership contracts will retain their existing contract until the minimum term expires. After the minimum contract period has expired, the price will be changed. In this case, the customer has the right to terminate the contract without prior notice.

The class fee must be paid in full before the class starts. Registration for the class does not entitle you to participate if the class fee is not paid on time. Payment for the lessons is made online by bank card payment. Immediately after payment the client’s balance is topped up by the number of paid classes. If there is a membership, the membership fee is collected monthly by direct debit to SEPA. If the direct debit attempt fails for reasons related to the client (e.g. incorrect bank details or insufficient funds in the account), Way to Pole & Dance represented by Elena Bosalygo is entitled to charge the client 11 Euros for a refund.

All purchased classes and packages are personalised, non-transferable and cannot be shared by more than one person.

Each purchased class, package or membership has its own validity period, after which all unused classes will expire and no refunds will be given. In case of purchasing a new training package, in exceptional cases the studio allows the client to use the expired training sessions within the duration of the new training package.

MEMBERSHIP

  • Way to Pole & Dance represented by Elena Bosalygo offers different types of membership contracts, each of which allows the client to attend a certain number of classes per month. The membership price includes any class at any time, as long as it does not exceed the maximum number of classes allowed per month. The client has the right to purchase an additional package of classes with a discount if they wish to attend more classes per month than the membership allows.
  • Any membership contract has a validity period of 12 months and cannot be cancelled before the expiry of this period. However, during this period, the client has the right to upgrade to a more expensive tariff. After 12 months, the membership contract is automatically renewed indefinitely. From this point onwards, the customer has the right to terminate the contract at any time with at least 30 days’ notice. Notice of cancellation must be given in writing by e-mail to info@waytopoleanddance.de  .
  • Way to Pole & Dance represented by Elena Bosalygo has the right to terminate the membership contract with the client if the client violates these general terms and conditions, behaves disrespectfully towards other members of the group or studio staff, does not follow the instructions of the teacher during the training.
CLASS ATTENDANCE

ATTENDANCE

It is not possible to attend a class without registration in the booking system.

PERMISSIBLE AGE

Classes may be attended by those aged 16 years and over, unless it is a separate class for children, which specifies the age of participants in addition. All persons under 18 years of age require written consent from a parent or guardian to attend the class.

LATE ARRIVAL

In case of lateness for more than 7 minutes after the start of the class, the teacher has the right not to allow the client to participate in the class for safety reasons (poor quality warm-up can lead to injuries). In this case, the class fee will not be refunded either partially or in full.

PHOTOGRAPHY AND VIDEOGRAPHY

All photos and videos that the client takes at Way to Pole & Dance represented by Elena Bosalygo are for personal use only. Commercial use is prohibited. When taking photos or videos, the client is obliged to ensure that other people, including teachers, are not in the camera lens. Filming of other people is allowed only with their consent. 

DRESS CODE

HYGIENE RULES

There is a dress code for each type of class. For pole sport classes, bare arms and legs are required. If the client comes to the class in inappropriate clothing, some of the tricks will be impossible to perform due to the lack of adhesion of the body and the pole. The teacher is not obliged to offer alternative exercises. Money for the lesson will not be refunded. For HEELS POLE lessons, kneepads are required. For some acrobatic tricks special shoes are required.

It is forbidden to wear any jewellery, including but not limited to: rings, bracelets, chains, hairpins during pole or aerial classes. These items may scratch the equipment of the studio, as well as injure the client. In case of equipment damage, Way to Pole & Dance represented by Elena Bosalygo has the right to demand compensation up to full replacement of the damaged equipment at the expense of the client.

After the class, the client is obliged to leave the pole clean, removing all traces of grip and sweat, using the cleaning agent and a cloth/towel provided by the studio. If the client has used a mat provided by the studio, the client is also obliged to wipe the mat with a studio-provided cleaner and a cloth/towel.

It is mandatory to remove street shoes when entering the studio. If clients attend a class where shoes are required, these shoes must be changed, clean and must not be the shoes the client came to the studio in from the street, regardless of the weather.

SPOTTING OF CLIENTS DURING THE PERFORMANCE ON THE POLE OR AERIALS

By coming to classes at the Way to Pole & Dance represented by Elena Bosalygo, the client agrees that the teacher has the right to spot the client, while touching the client’s body. If the client does not want to be touched during the class, the client must inform the teacher in advance of each class attended by the client. In exceptional cases, when the client is in real danger of falling, the teacher has the right to support the client against the client’s prohibition.

CANCELLATION OF PREVIOUSLY BOOKED CLASSES

CANCELLATION

CUSTOMER CANCELLATION

Client can cancel a booked class without loss of price at least 48 hours before the class starts. Cancellation takes place in the booking system or in writing by emailing info@waytopoleanddance.deIn case of later cancellation or no-show, the full class fee will be charged. If the class has to be cancelled due to illness, this must be notified in writing by email on info@waytopoleanddance.de prior to the start of the class. On presentation of a medical certificate, the class can be rescheduled at no cost. No cancellation or free postponement after the end of a previously booked class will be accepted, even if a medical certificate is presented. Class fees are non-refundable.

ILLNESS WITH A DOCTOR’S NOTE

If a class package or membership needs to be extended due to illness, this must be notified in writing by mail to info@waytopoleanddance.de If a medical certificate is presented, the class package and/ or membership will be extended for the period of illness and rehabilitation only if the need to extention is notified in advance. It is not possible to extend the package or membership afterwards.

CANCELLATION OF PARTIES, WORKSHOPS

Special events are subject to a separate cancellation policy, which will be advised additionally at the time of booking. Free cancellation period for the client can be claimed up to 30 days before the event.

STUDIO CANCELLATION

In case of cancellation by the studio, all clients who have booked a cancelled class will be informed as far in advance as possible by email. The class will be held if at least 3 people are registered for the class. If there are less than 3 people registered for the class, the classes will be cancelled in advance, namely: classes starting before 12.30 are cancelled the night before at 22.00. Classes starting after 12.30 are cancelled 6 hours before the start of the class. In case of force majeure, classes can be cancelled in a shorter time, about which the client will always be informed by the email with which the cancelled class was booked. In case of cancellation by the studio, the booked class will be refunded to the client’s balance.

CHANGES

SCHEDULE AND OPENING HOURS OF THE STUDIO

Way to Pole & Dance represented by Elena Bosalygo reserves the right to change the schedule of classes and studio opening hours. The studio informs about all changes in advance on the website and / or in the booking system, and / or in social media. Schedule changes do not entitle to a refund. The studio has the right to reduce the number of regular classes during public holidays or to close for a few days for holidays which will be announced on the website/booking system/social media at least 14 days in advance. If the studio closes for holidays, the client is entitled to an extension of the packages or membership contract for the period of closure. 

SPECIAL EVENTS, MASTERCLASSES, GUEST STARS

Way to Pole & Dance represented by Elena Bosalygo has the right to hold irregular master classes, parties, events, including changing the regular schedule. The cost of each event is declared separately. The client is assigned a place only after payment. Free cancellation of the event is allowed at least 10 days before the event, unless otherwise agreed at the time of booking. The participant who cannot attend the booked event has the right to find a person to whom he/she/they will give the reserved place, about which he/she/they must notify the studio by e-mail info@waytopoleanddance.de  .

STORAGE

CUSTOMER PERSONAL DATA

Way to Pole & Dance represented by Elena Bosalygo stores the necessary personal information about clients. The client consents to the collection, processing and use of this data for the purposes of business operations. The client has the right to withdraw this consent at any time, in which case all data will be deleted after the business transaction is completed.

AMENDMENTS AND ADDITIONS TO THESE GENERAL TERMS AND CONDITIONS

Way to Pole & Dance represented by Elena Bosalygo reserves the right to change these general terms and conditions. When new general terms and conditions are published on the studio’s website, the old general terms and conditions become null and void.

FINAL PROVISIONS

In case of disagreement with these general terms and conditions, the client is not allowed to participate in classes, open trainings and/ or events. In case of misunderstanding of the provisions of these general terms and conditions, the client has the right to receive clarifications in writing by e-mail info@waytopoleanddance.de  to get clarification.
